Receiving your Magnum Products

Upon delivery of your Magnum products and before signing the “Proof of Delivery” for the delivered item/s. Please inspect the item/s for any clear and obvious transit damage. Once satisfied that they are in good order and condition, they can be signed for. If damage has occurred, we advise either noting on the “Proof of Delivery” or POD, that the item was not received in good order, or declining to accept the item due to damage. Photos of the damage are also very helpful. Accepting damaged items and signing the “Proof of Delivery” without noting any damage leaves no recourse for compensation by the carrier

WARRANTY
WARRANTY STATEMENT

In addition to the rights and remedies that you have under the Australian Consumer Law or any other applicable law, Magnum MFG Pty Ltd ACN 112 862 469 (Magnum MFG) provides the following warranty against defects (Warranty):

WARRANTY

1.1 Subject to the provisions of this Warranty, the warranty period where Magnum MFG will repair or replace any Goods, without charge, that prove to be defective by reason of improper workmanship or material components (and none of the statutory rights or remedies apply) is:

  • (a) for all ISO 9001 certified Arrow Boards:
    • (i) five (5) years on the LED’s which make up the combination of the different arrows; and
    • (ii) two (2) years on all other components.
  • (b) for all other Goods that are used for private household and domestic use, twelve (12) months.
  • (c) for all Goods that are used for commercial purposes, three (3) months.

1.2 For the purpose of this Warranty Statement, reference to Goods means all goods supplied by Magnum MFG to the Customer.

1.3 This Warranty does not cover:

  • (a) normal fair wear and tear;
  • (b) defects, loss, or damage caused directly or indirectly by or as a result of:
    • (i) any defect, deterioration, weakening, or collapse of the structure to which the Goods are installed occurring at any time;
    • (ii) incorrect or improper installation by anyone other than Magnum MFG’s authorized representatives;
    • (iii) any damage to or deterioration in the condition of the Goods occurring in transit by the Customer’s nominated or appointed carrier or occurring after delivery and prior to installation of the Goods;
    • (iv) deterioration arising from or attributable to the installation of the Goods after it is known to be defective; or
    • (v) external causes (dropping, accident, collision, fire, immersion in water, freezing or striking objects);
    • (vi) off-road use of the vehicle to which the product is installed.
  • (c) defects or deterioration which, in the opinion of Magnum MFG, have been caused by careless or improper handling, negligence, misuse, care or maintenance instructions, alterations, or repairs carried out by anyone other than Magnum MFG’s authorized representatives, or by fair wear and tear;
  • (d) where any part of the Goods has been modified, disassembled, misused, abused, damaged or not maintained in accordance with requirements and specifications for the Goods; or
  • (e) any Goods that have undergone any type of service, maintenance, or works by a party other than Magnum MFG or a third party approved by Magnum MFG.

1.4 Magnum MFG’s Goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

CLAIM

2.1 In order to claim under this Warranty, a party must:

  • (a) immediately upon becoming aware of circumstances giving rise to a claim, notify Magnum MFG in writing setting out full details of the claim within seven (7) days of purchase;
  • (b) provide Magnum MFG with proof of purchase of the Goods in relation to its claim; and
  • (c) allow Magnum MFG, its employees and/or agents full and free access to the Goods in relation to which the claim is made and to the place where the Goods are located for the purpose of conducting any inspection and tests that Magnum MFG may in its absolute discretion consider necessary to determine whether the claim is justified or not.

2.2 Any Goods the subject of a warranty claim may only be returned to Magnum MFG by prior arrangement with Magnum MFG.

2.3 Any claiming party must bear the expense for the removal (if necessary) and return of the Goods and such other expenses incurred by the claiming party and associated with a warranty claim.

2.4 Any Goods that the Customer wishes to return must be packaged securely to prevent any damage during the return. Failure to do so will result in the withholding by Magnum MFG of any refund amount payable to cover the costs of the damages to the Goods.

2.5 Any warranty of Magnum MFG cannot be assigned or transferred to any third party.

GENERAL

4.1 Warranty claims will be processed by Magnum MFG in a timely manner, and a report pertaining to the warranty claim will be made available to the claiming party.

4.2 Magnum MFG may at its discretion elect to repair or replace the Goods. Magnum MFG may also at its discretion elect to substitute the Goods with a similar alternative goods of Magnum MFG’s choosing.

4.3 Magnum MFG does not have to repair or replace the Goods under this Warranty if this Warranty does not apply, this Warranty is voided and/or the Goods have been modified, disassembled, misused, improperly or inappropriately installed, repaired, abused, damaged or not maintained.

4.4 This Warranty is limited to repair, replacement, or substitution of Goods only. To the extent permitted by the law, Magnum MFG will not be liable for any loss or damage caused to property or persons arising from any cause whatsoever.

The provisions of this Warranty shall apply in addition to and not in substitution for Magnum MFG’s Terms & Conditions.

This Warranty is only valid and enforceable in Australia.

THIRD PARTY WARRANTIES

5.1 Any Goods that are not manufactured by Magnum MFG may come with a warranty provided by the manufacturer.

5.2 Magnum MFG is not responsible for the manufacture of such Goods but will assist you in any claim you may have against any manufacturer for repair and/or replacement of such Goods.

5.3 Magnum MFG will provide you with a copy of such manufacturer warranty on supply of any Goods to you.

5.4 Magnum MFG is not responsible for the manufacturer warranty or the manufacturer’s compliance with the Australian Consumer Law.
